WMACSA, Inc. ("WMACSA," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect, how we use it, how we protect it, and the choices you have regarding your information.

By becoming a member of WMACSA, attending a WMACSA event, registering on our website, donating to WMACSA, or otherwise providing personal information to us, you accept the practices described in this Policy.

ARTICLE I

SCOPE OF THIS POLICY

This Policy applies to personal information that WMACSA collects in connection with its activities as a Virginia nonstock corporation and 501(c)(3) tax-exempt charitable organization, including through:

Membership applications, renewals, and account management;
Event registrations, attendance, and participation;
Scholarship and grant applications;
Communications with members, donors, and the public;
Use of WMACSA's website and online services;
Donations and contributions;
Volunteer activities and committee participation.

This Policy does not apply to information collected by third parties through their own services, even when accessed through links provided by WMACSA. Those services are governed by their own privacy practices.

ARTICLE II

INFORMATION WE COLLECT

Section 1. Information You Provide Directly.

We collect personal information that you voluntarily provide when interacting with WMACSA, which may include:

Name, mailing address, email address, and phone number;
Employer name, job title, and professional credentials;
Payment information for dues, registrations, and donations (processed by third-party payment processors; WMACSA does not retain full credit card numbers);
Information you provide in scholarship or grant applications, including educational and professional history;
Information you include in correspondence or communications with us;
Demographic information you voluntarily disclose.

Section 2. Information Collected Automatically.

When you visit the WMACSA website, our service providers may automatically collect certain information about your visit, which may include:

Your IP address and general geographic location;
The type of browser and device you are using;
The pages you visit and the time you spend on them;
The website that referred you to us, if any;
Cookies and similar tracking technologies (you may control these through your browser settings).

Section 3. Information from Events.

At WMACSA meetings and events, we may collect:

Attendance records and event participation history;
Photographs and video recordings, subject to the photo release in the Membership Agreement;
Information shared by attendees in connection with educational discussions, surveys, or feedback forms.

Section 4. Information from Third Parties.

We may receive information about you from third parties, including service providers, event partners, and publicly available sources, in connection with our charitable mission. We will treat any such information in accordance with this Policy.

ARTICLE III

HOW WE USE YOUR INFORMATION

We use the personal information we collect for the following purposes:

Section 1. Member and Event Administration.

Processing membership applications, renewals, and cancellations;
Managing event registrations, attendance, and follow-up;
Communicating about meetings, programs, and member benefits;
Issuing receipts and disclosure statements;
Maintaining the membership roster and contact records.

Section 2. Mission and Program Delivery.

Administering scholarships, grants, and educational programs;
Distributing safety publications and educational materials;
Conducting research and analysis related to construction safety;
Pursuing the Corporation's charitable mission.

Section 3. Communications.

Sending newsletters, safety bulletins, and educational content;
Notifying you of WMACSA events and activities;
Soliciting donations and member feedback;
Conducting advisory votes and surveys.

Section 4. Legal and Compliance.

Complying with applicable federal, state, and local laws;
Filing required tax returns and regulatory reports;

Protecting the rights, property, and safety of WMACSA, its directors, members, and the public.

Section 5. Organizational Operations.

ARTICLE IV

HOW WE SHARE YOUR INFORMATION

Section 1. We Do Not Sell Your Information.

WMACSA does not sell, rent, or trade your personal information to third parties for their marketing purposes.

Section 2. Service Providers.

We share information with trusted service providers who perform functions on our behalf, such as payment processing, email distribution, website hosting, event registration, and data storage. These providers are authorized to use your information only as necessary to perform their services for us, and they are required to protect your information.

Section 3. Required Disclosures.

We may disclose your information when we believe in good faith that disclosure is required by law or legal process; to comply with a subpoena, court order, or government request; to protect against fraud or other illegal activity; to enforce our agreements and policies; or to protect the rights, property, or safety of WMACSA, our members, or the public.

Section 4. Successor Organizations.

In the event WMACSA merges with, dissolves into, or transfers assets to another nonprofit organization, your personal information may be transferred to the successor organization as part of that transaction, subject to comparable privacy protections.

Section 5. Aggregate and De-Identified Information.

We may share aggregate or de-identified information that does not identify any individual with donors, grantmakers, partners, and the public to demonstrate our impact and support our mission.

Section 6. Member Directory.

If WMACSA maintains a member directory, basic information such as your name and employer may be visible to other members in good standing. You may opt out of the directory by submitting a written request to the Secretary.

Section 7. Other Members and Event Attendees.

Information you voluntarily share at meetings, events, or in WMACSA-affiliated communications may be observed by other attendees. WMACSA cannot control how other attendees use information you choose to disclose in such settings.

ARTICLE V

DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with our legal and regulatory obligations, resolve disputes, and enforce our agreements. Specific retention periods include, generally:

Membership records: for the duration of membership and seven (7) years thereafter;
Financial records and donation records: at least seven (7) years, as required for tax and audit purposes;
Event attendance records: at least three (3) years;
Scholarship applications: at least three (3) years after award decisions;
Email communications: at least three (3) years;
Corporate records (Articles, Bylaws, board minutes): permanently.

When information is no longer needed, we will dispose of it in a secure manner.

ARTICLE VI

SECURITY OF YOUR INFORMATION

We take reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. These safeguards include limiting access to personal information to those who need it for authorized purposes, using secure third-party service providers for payment processing and data storage, and maintaining password-protected access to sensitive records.

Despite these efforts, no method of transmission over the Internet or method of electronic storage is completely secure. You acknowledge that we cannot guarantee absolute security of your information, and you provide your information to us at your own risk. You are responsible for maintaining the confidentiality of any account credentials you use to access WMACSA services.

ARTICLE VII

YOUR RIGHTS AND CHOICES

Section 1. Access and Correction.

You may request access to the personal information we hold about you, and you may request that we correct any inaccurate information. To make such a request, contact us using the information in Article XI.

Section 2. Marketing and Communications Preferences.

You may opt out of non-essential communications (such as newsletters, general announcements, and fundraising appeals) at any time using the unsubscribe link in our emails or by contacting us directly. Certain communications essential to your membership (such as renewal notices, billing communications, and policy updates) cannot be opted out of while your membership is active.

Section 3. Deletion.

You may request that we delete your personal information at any time. We will honor such requests except where we are required to retain information for legal, regulatory, tax, audit, or legitimate organizational record-keeping purposes.

Section 4. Withdrawal of Membership.

You may terminate your membership at any time in accordance with the Membership Agreement and Terms and Conditions. After termination, we will retain only the information necessary for our legal, regulatory, and record-keeping purposes.

Section 5. Cookies and Tracking.

Most web browsers allow you to control cookies through their settings. You may set your browser to refuse cookies or to alert you when cookies are being sent. Some features of the WMACSA website may not function properly if you disable cookies.

ARTICLE VIII

CHILDREN'S PRIVACY

WMACSA's membership program is open to individuals age eighteen (18) or older. We do not knowingly collect personal information from children under thirteen (13) years of age. If we learn that we have inadvertently collected information from a child under thirteen, we will delete it as soon as practicable. If you believe a child has provided personal information to us, please contact us at the information in Article XI.

ARTICLE IX

GEOGRAPHIC SCOPE

WMACSA operates primarily within the United States, with a particular focus on the Washington metropolitan region. If you access WMACSA services or provide information to us from outside the United States, please understand that your information will be processed in the United States, which may have different privacy laws than your country of residence.

ARTICLE X

CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or applicable laws. The current version will be available at our website with the date of last update shown at the top. Material changes will be communicated to active members by email at least thirty (30) days before they take effect. Your continued participation in WMACSA activities after the effective date of any update constitutes acceptance of the revised Policy.

Code of Conduct

WMACSA, Inc. (the "Corporation") is committed to maintaining a respectful, safe, and inclusive environment that advances its charitable mission of construction worker safety. This Code of Conduct (the "Code") sets out the standards of behavior expected of every person who participates in the Corporation's activities.

ARTICLE I

SCOPE AND APPLICATION

Section 1. Who This Code Covers.

This Code applies to all persons participating in any capacity in the Corporation's activities, including:

Directors and officers of the Corporation;
Members of the Corporation's membership program;
Volunteers, committee members, and committee chairs;
Speakers, presenters, and event facilitators;
Attendees at WMACSA meetings, events, and activities, whether members or non-members;
Scholarship recipients, grant recipients, and program participants;
Service providers and vendors interacting with WMACSA representatives in connection with Corporation business.

Section 2. Where This Code Applies.

This Code applies at all WMACSA meetings, events, and activities, whether held in person or virtually, and to all WMACSA-related communications, including emails, online forums, social media channels operated by the Corporation, and other communications conducted on behalf of or in association with the Corporation.

Section 3. Relationship to Other Documents.

This Code supplements, and does not replace, the Corporation's Articles of Incorporation, Bylaws, Conflict of Interest Policy, Membership Agreement and Terms and Conditions, and applicable federal, state, and local laws. In the event of conflict, the Articles of Incorporation and applicable law shall control.

ARTICLE II

CORE PRINCIPLES

All persons covered by this Code shall conduct themselves in accordance with the following principles:

Section 1. Mission Alignment.

Act in furtherance of the Corporation's charitable mission of promoting construction worker safety. Do not use WMACSA activities or affiliation for purposes inconsistent with this mission.

Section 2. Respect and Dignity.

Treat every person involved in WMACSA activities with respect and dignity, regardless of role, background, identity, or experience level.

Section 3. Integrity.

Act honestly in all dealings with and on behalf of the Corporation. Avoid even the appearance of impropriety.

Section 4. Compliance.

Comply with all applicable laws and with the Corporation's governing documents and policies.

Section 5. Stewardship.

Use the Corporation's name, resources, and reputation responsibly and in service of its mission.

ARTICLE III

STANDARDS OF CONDUCT

Section 1. Professional Behavior.

All persons shall behave professionally and courteously in WMACSA settings. This includes arriving on time when scheduled, communicating respectfully, listening to others, and contributing constructively to discussions and activities.

Section 2. Anti-Harassment.

Harassment of any kind will not be tolerated. Prohibited harassment includes, but is not limited to:

Verbal, written, or physical conduct that demeans, threatens, or intimidates another person;
Unwelcome sexual attention, advances, or comments;
Stalking, following, or persistent unwelcome contact;
Photography or recording of others without consent;
Disruption of meetings, events, or communications;
Bullying, including online bullying or coordinated public criticism intended to humiliate.

Section 3. Anti-Discrimination.

The Corporation does not tolerate discrimination based on race, color, religion, sex, sexual orientation, gender identity, gender expression, national origin, ethnicity, ancestry, age, disability, medical condition, marital status, parental status, military or veteran status, citizenship status, genetic information, language, socioeconomic status, education, body size, or any other characteristic protected by applicable law. This non-discrimination principle applies to participation in events, access to programs and benefits, scholarship awards, volunteer opportunities, board service, and all other Corporation activities.

Section 4. Inclusive Environment.

The Corporation seeks to create an inclusive environment for the diverse community of construction workers, contractors, safety professionals, and members of the public it serves. All persons are expected to actively contribute to this environment by listening to others, considering diverse perspectives, and refraining from conduct that excludes or marginalizes any group.

Section 5. Honest Representation.

Persons covered by this Code shall not misrepresent their credentials, employer, professional qualifications, or relationship to the Corporation. Persons shall not claim authority to act for the Corporation that they do not actually possess.

Section 6. Use of WMACSA Name and Resources.

The WMACSA name, logo, and resources shall be used only in furtherance of the Corporation's mission and only as authorized. Specifically:

No person shall use the WMACSA name, logo, or affiliation for personal commercial gain, political endorsement, or any purpose not authorized by the Board of Directors in writing;
No person shall imply, in marketing, social media, or other communications, that the Corporation endorses their personal business, services, or political views;
No person shall use Corporation property, mailing lists, or contact information for unauthorized purposes;
No person shall speak publicly on behalf of the Corporation without prior authorization from the President or the Board of Directors.

Section 7. Confidentiality.

Information shared at WMACSA meetings, by other members, or in connection with Corporation business that is reasonably understood to be confidential shall be treated as confidential. This includes, without limitation, personal information about members, scholarship applications, financial information, internal deliberations of the Board, and sensitive professional information shared in confidence.

Section 8. Conflicts of Interest.

Persons covered by this Code shall comply with the Corporation's Conflict of Interest Policy. Directors, officers, and committee members shall disclose actual or potential conflicts of interest and recuse themselves from decisions as required by that Policy.

Section 9. Compliance with Laws.

All persons shall comply with applicable federal, state, and local laws while participating in WMACSA activities. This includes laws governing nonprofit organizations, charitable solicitation, employment, anti-discrimination, intellectual property, taxation, and conduct generally.

Section 10. Safe Environments.

Persons attending WMACSA meetings, events, and activities shall not engage in conduct that creates an unsafe physical environment, including but not limited to violence, threats of violence, possession of unauthorized weapons, intoxication that endangers others, or interference with venue safety procedures.

ARTICLE IV

REPORTING CONCERNS

Section 1. How to Report.

Any person who believes that a violation of this Code has occurred may report the concern through one or more of the following channels:

By email to the President or Secretary at the Corporation's contact addresses;
By written letter to the Corporation at its principal office address;
In person, verbally, to any director or officer of the Corporation;
If the concern involves the President, by report to any other director.

Section 2. Information to Include.

Reports should include, to the extent the reporting person is able to provide it: a description of the conduct of concern, the persons involved, the date and location, names of any witnesses, and any relevant supporting documents. Anonymous reports will be considered but may be more difficult to investigate.

Section 3. Confidentiality of Reports.

The Corporation shall maintain the confidentiality of reports to the extent reasonably possible, consistent with the need to investigate and respond. The identity of the reporting person will be shared only with those who have a legitimate need to know.

Section 4. Reports to Law Enforcement.

Nothing in this Code prevents any person from reporting conduct to law enforcement, regulatory authorities, or any other appropriate external authority. In cases involving alleged criminal conduct, the Corporation may itself report to law enforcement.

ARTICLE V

INVESTIGATION AND RESOLUTION

Section 1. Initial Review.

Upon receipt of a report, the President (or, in the case of a concern involving the President, another designated director) shall conduct an initial review to determine whether the report alleges conduct that, if true, would violate this Code.

Section 2. Investigation.

If the initial review indicates a potential violation, the Board of Directors or a committee designated by the Board shall investigate the matter. The investigation shall be conducted fairly, promptly, and with appropriate confidentiality. The investigator(s) shall not have a personal stake in the outcome.

Section 3. Due Process.

Any person alleged to have violated this Code shall be:

Informed of the substance of the allegation in reasonable detail;
Given a reasonable opportunity to respond, in writing or orally, before any final decision is made;
Given the opportunity to identify relevant witnesses or supporting information.

Section 4. Resolution.

After investigation, the Board of Directors (or designated committee) shall determine whether a violation occurred and, if so, what corrective action is appropriate. The Board may consult outside advisors as needed.

ARTICLE VI

DISCIPLINE AND ENFORCEMENT

Section 1. Range of Consequences.

Violations of this Code may result in a range of consequences depending on severity and circumstances, including but not limited to:

A verbal or written warning;
A requirement to apologize, make restitution, or attend training;
Suspension or removal from a committee, leadership role, or volunteer position;
Removal from a director or officer position;
Suspension or termination of membership;
Exclusion from WMACSA events, meetings, or activities;
Loss of scholarship or grant eligibility;
Referral to law enforcement or regulatory authorities;
Civil legal action by the Corporation.

Section 2. Immediate Action.

In cases where conduct poses an immediate threat to safety or to the Corporation's interests, the President or any director may take immediate interim action, including removing the person from a meeting or event, suspending their participation pending investigation, or contacting law enforcement.

Section 3. Record-Keeping.

The Corporation shall maintain records of all reports, investigations, and resolutions for at least three (3) years, subject to applicable record retention requirements and the confidentiality provisions of this Code.

ARTICLE VII

ANTI-RETALIATION

No person shall be retaliated against for making a good-faith report of an actual or potential violation of this Code, for participating in an investigation, or for refusing to engage in conduct prohibited by this Code. Retaliation is itself a violation of this Code and may result in the consequences described in Article VI.

Retaliation includes, but is not limited to, any adverse action taken against a reporter, witness, or participant in an investigation in connection with their participation, such as: exclusion from activities, removal from positions, harassment, intimidation, or efforts to damage the person's reputation.

Good faith does not require that the report ultimately be substantiated. It does require that the reporter have a reasonable basis for the concern and not knowingly make false allegations. Knowingly false allegations are themselves a violation of this Code.

ARTICLE VIII

ACKNOWLEDGMENT AND ADOPTION

Section 1. Annual Acknowledgment.

Each director, officer, and committee chair shall acknowledge in writing each year that they have received, read, understand, and agree to comply with this Code. The acknowledgment form is provided as Exhibit A.

Section 2. Member Acceptance.

Members of the Corporation's membership program acknowledge and agree to comply with this Code as part of their acceptance of the Membership Agreement and Terms and Conditions.

Section 3. Event Attendee Acceptance.

Attendees at WMACSA events shall be deemed to have accepted this Code by virtue of their attendance, and this Code may be posted, distributed, or summarized at events at the Corporation's discretion.

Section 4. Amendment.

This Code may be amended at any time by the affirmative vote of two-thirds (2/3) of the directors then in office. Amended versions shall be communicated to current directors, officers, and committee members and posted in such locations as the Board may designate.

Section 5. Effective Date.

This Code is effective as of the date adopted by the Board of Directors and remains in effect until amended or repealed.
